The PAIA Act<\/strong><\/p> The Promotion to Access of Information Act (PAIA) grants a requester access to records of a private body, if the record is required for the exercise or protection of any rights. If a public body lodges a request, the public body must be acting in the public interest.<\/p> \u00a0<\/p> Requests in terms of PAIA shall be made in accordance with the prescribed procedures, at the rates provided. The forms and tariff are dealt with in paragraphs 6 and 7 of the Act.<\/p> \u00a0<\/p> Requesters are referred to the PAIA Guide in terms of Section 10 which has been compiled by the Information Regulator, which will contain information for the purposes of exercising Constitutional Rights. POPIA notice<\/strong><\/p> In terms of POPIA we are required to provide you with a description of the personal information that we process and why it is processed, and who we may share this information with, which detail is described in our Privacy Notice available here:<\/p> https:\/\/netsurit.com\/en-za\/company\/netsurit-privacy-notice\/<\/a><\/p> \u00a0<\/p> <\/a><\/a>1.8. <\/strong>Request Procedure<\/strong><\/p> Form of request:<\/strong><\/p> The requester must use the prescribed forms available on the website of the Information Regulator at https:\/\/inforegulator.org.za\/paia-forms\/<\/a> to make the request for access to a record. The form and request must be submitted to the Deputy Information Officer of Netsurit. This request must be made to the address, postal address or e-mail address of Netsurit as provided for herein above.<\/p> \u00a0<\/p> The requester must provide sufficient detail on the request form to enable Netsurit to identify the record AND the requester. The requester should indicate which form of access is required. The requester should indicate if any other manner is to be used to inform the requester and state the necessary particulars to be so informed.<\/p> \u00a0<\/p> The requester must identify the right that is sought to be exercised or to be protected and provide an explanation of why the requested record is required for the exercise or protection of that right.<\/p> If a request is made on behalf of another person, the requester must submit proof of the capacity in which the requester is making the request to the satisfaction of the head of the private body.<\/p> \u00a0<\/p> <\/a>1.9. Fees<\/strong><\/p> A requester who seeks access to a record containing personal information about that requester is not required to pay the request fee. Every other requester, who is not a personal requester, must pay the required request fee.<\/p> \u00a0<\/p> Netsurit shall notify the requester (other than a personal requester) by notice, requiring the requester to pay the prescribed fee (if any), being, at the time of drafting this document, an amount equal to R50 (fifty Rand), and Netsurit shall not be required to process the request until such time as the aforesaid fee (if applicable) has been settled.<\/p> The requester may lodge an application to the court against the tender or payment of the request fee.<\/p> Records may be withheld until the fees have been paid.<\/p> \u00a0<\/p> After Netsurit has made a decision on the request, the requester shall be notified by Netsurit in the required form. If the request is granted then a further access fee must be paid for by the requester for the search, reproduction, preparation and for any time that Netsurit has spent in excess of the prescribed hours to search and prepare the record for disclosure, subject to the prescribed fees set out in the regulations to the Act.<\/p> \u00a0<\/p> The fee structure is available on the website of the Information Regulator at https:\/\/inforegulator.org.za\/paia-forms\/<\/a>.<\/p> \u00a0<\/p> <\/a><\/a>1.10. Manual Availability<\/strong><\/p> The Manual is available for inspection free of charge at the office of Netsurit during business hours and upon request.<\/p>
